Rules of contest «Give your opinion»
Article 1 – Structure
The company SKI BREAK SAS, with a capital of 250,000 euros, located 1160, avenue Joseph Thoret 74190 Passy Mont Blanc - FRANCE and registered with the Trade and Companies register in Annecy under No 493 722 052, hereafter referred to as the "Organising Company", organises a free contest entitled "Give Your Opinion", hereafter referred to as the "Contest".
To enter the Contest, participants are asked to complete in full and return the satisfaction survey they received following their booking.
The legal rules of this Contest are detailed in this document. Instructions that are given to participants on the successive screens of the Contest website supplement and complete these rules.
Article 2 – Participation
This contest is open to any natural person who completed the satisfaction survey in full and who rented boardsport equipment from the Organizing Company. All employees of the Organising Company, along with employees of any companies contributing to running the Contest, are excluded from participation. Such exclusion is also applicable to the families of the employees of these above mentioned companies.
Where the participant is a minor natural person, they declare and acknowledge that they have obtained permission to enter this Contest from the person(s) holding parental authority over them, and that this or these person(s) holding such parental authority have agreed to guarantee compliance on the part of the participant with all the provisions of these rules.
Participation in the contest implies unconditional and irrevocable acceptance of these rules (hereafter the "Rules") in all their provisions, of the rules of conduct in place on the Internet, as well as of the current laws and regulations applicable to such contests in France.
Article 3 – Contest Length and Participation Details
The contest "Give you Opinion" will take place from January 1st, 2017 to June 1st, 2017 at midnight (Metropolitan France time).
The Organising Company reserves the right to postpone, modify, cancel or renew the Contest if necessary. In any event, it assumes no responsibility or liability in this area.
To enter the contest, simply do as follows:
- click on the link received in the satisfaction survey email sent at the end of your stay.
- fully complete all fields of the satisfaction survey.
- click submit at the end of the survey.
Only one participation is allowed per booking (same booking number, same name, same address, same email address).
Article 4 – Prize allocation
The Contest winner will receive a gift card worth 500€ valid for one or several rental(s) of boardsport equipment from the websites Skimium.com. This gift card will be valid from October 1st, 2017 to May 30, 2018 for a rental period between October 1st, 2017 and May 30, 2018.
Non-use of the gift card within the period specified above will not lead to any extension.
Only one gift card will be awarded. There will be only one winner to this Contest.
Article 5- Winner selection
The winner will be drawn by lot by the Organising Company. The prize draw will take place on June 2, 2017 at the latest. The winner will be contacted directly by the Organising Company.
Article 6- Publication of the results
The name of the winner may be published by the Organising Company through the following: skimium.com website, Skimium blog, social networks (Facebook, Twitter, Google+, Pinterest, Instagram), stores affiliated to the Skimium network
The Organising Company may ask for authorisation to use the winner’s full name, address and image (still or video) in advertising without any royalties or payments, rights or other privileges whatsoever other than attribution of their prize. This ability, however, will not place any obligation on the Organising Company.
Article 7- Prize delivery conditions
The prizes chosen for the winner cannot be challenged by the winner, nor exchanged for monetary value (in full or partial), nor may be exchanged for another prize of any value or for any reason.
Participants authorize any verification concerning their identity or their personal information. Any false information such as identity or address will automatically disqualify the participant from the Contest.
Article 8 – Limitation of Liability
The Organising Company will not be held liable if, in cases of force majeure or outside of its control, the Contest must be modified, shortened or cancelled.
The Company has the complete right to extend the participation period, and/or to postpone any planned date.
Any changes to the rules will be posted online on the website skimium.com and will become effective as soon as it is posted. Every participant will be deemed to have accepted all modifications to the rules through their participation in the Contest, as of the date that the change enters into force. All participants who refuse any modifications that are made must end their participation in the Contest.
The Organising Company may cancel any or part of the Contest if it appears that fraud of any kind, particularly computer fraud, takes place in conjunction with Contest participation. All fraud leads to disqualification of the participant.
The Organising Company reserves the right, under these circumstances, to revoke the participation of any person committing fraud, without the participant having any right to contest this decision.
The Organising Company reserves the right to pursue legal action against whomever committed or attempted to commit fraud. It will not assume any responsibility of any sort regarding participants and the fact that fraud had perhaps been committed.
Participation in the Contest implies knowledge and acceptance of the characteristics and limitations of the Internet. This is particularly true regarding technical performance, delays in examining or transmitting information, the risk of interruption, and more generally, the risks linked to all connections and transmissions on the Internet, absence of protection of certain data against possible interception and the risk of possible viruses on the network.
Accordingly, the Organising Company shall in no circumstance be held liable, with this list being non-exhaustive:
The Organising Company shall not be held responsible for any direct or indirect damage resulting from an interruption or a malfunction of any sort, for whatever reason, or any direct or indirect damage that resulted, of any way, from use of the site. It is the responsibility of all participants to take appropriate measures in order to protect their own data and/or software installed on their electronic devices against all attacks. The connection of any person to the site/application and participation in the Contest is done under their complete responsibility.
It is agreed that, except in the event of an obvious error, the Organising Company may rely on, in particular for the purposes of proving any act, fact or omission, the programmes, data, files,
recordings, operations and other items (such as monitoring reports or other reports) of a nature or in or on IT or electronic formats or media, prepared, received or maintained directly or indirectly by the Organising Company, and in particular on its IT systems.
The participants undertake not to dispute the admissibility, validity or probative force of any items of an IT or electronic nature or in or on the IT or electronic formats or media referred to above, on the basis of any legal provisions whatsoever which may stipulate that certain documents must be in writing or signed by the parties in order to constitute evidence.
Thus the elements in question shall constitute proof and, if they are produced as evidence by the Organising Company in any litigious or other proceedings, they shall be admissible, valid and enforceable as between the parties in the same manner, in accordance with the same conditions and with the same probative force as any document prepared, received or recorded in writing.
If a screen is displayed indicating that the participant is selected to take part in the product testing, a unique and confidential encrypted code will appear on screen. This code will allow the Organising Company to verify the link between the screen and the participant.
Article 10 – Personal Information
Personal data that must be recorded to sign up for the Contest is needed for participation in the Contest and will be utilised by the Organising Company, where appropriate, only for the drawing of Contest winners.
Personal data collected for the contest is treated in conformance with the data protection law of 6 January 1978 as amended.
This data may be accessed, corrected, or challenged. All Contest participants may exercise their rights relative to this data by contacting: SKI BREAK SAS 1160, avenue Joseph Thoret 74190 Passy Mont Blanc , France (include a copy of your identification documents in order to have the information deleted if desired).
Article 12 - Applicable Law and Competence
The Contest and these rules are exclusively governed by French law, in particular for any dispute that is related to the Contest or is directly or indirectly linked to it, without prejudice to possible conflict of laws rules that may exist. For all disputes between the parties, legal jurisdiction rules apply. Any question about the application or interpretation of these Rules, or any unforeseen question that is subsequently asked, shall be adjudicated upon definitively, depending on the nature of the question, by the Organising Company in accordance to French laws and regulations. Legal challenges are only admissible within two weeks following the Contest’s end.
